2. The petitioners are apprehending their arrest in connection with Kochas P.S. Case No. 171 of 2024, F.I.R. dated 12.06.2024 registered for the offences punishable under Sections 8(C), 20(b)(ii)(B), 29 of he N.D.P.S. Act.
3. The case relates to recovery of 03 Kgs. of Ganja from the house of the petitioners, 02 Kgs. of Ganja from the motorcycle as well as 690 Kgs. of Ganja from a truck which have been recovered in front of the house of the petitioners which was parked in front of their house.
4. Learned counsel for the petitioners submits that the petitioners have clean antecedents and they have been falsely
Patna High Court CR. MISC. No.5762 of 2025(2) dt.19-02-2025 2/2 implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioners have not committed any offence as alleged in the F.I.R.

Learned APP for the State, on the other hand, vehemently opposed the prayer for anticipatory bail of the petitioner and submits that it appears from the F.I.R. that 03 Kgs. of Ganja has been recovered from the house of the petitioners and 690 Kgs. of Ganja has been recovered from the truck which was standing in front of the house of the petitioners and apart from that 02 Kgs. of Ganja has been recovered from the motorcycle which was parked in the house of the petitioners.
6. Considering the aforesaid facts and circumstances of the case and the submissions made on behalf of the State, I am not inclined to grant the privilege of anticipatory bail to the petitioners in connection with Kochas P.S. Case No. 171 of 2024 pending in the Court of learned Sessions Judge, Rohtas at Sasaram.
7. Prayer is refused.
