In this case, the petitioner is seeking anticipatory bail in connection with Garkha P.S. Case No. 408 of 2018 registered for offence punishable under section 384/34 of the Indian Penal Code. Allegation has been made against two persons to have misappropriated the money of Rs.16,000/- connected with Indira Awas.
The learned counsel for the petitioner submits that the petitioner is ready to deposit the said money in the court below. In such view of the matter, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on provisional bail on furnishing bail bonds of Rs.10,000/-
Patna High Court Cr.Misc. No.7065 of 2019(2) dt.11-02-2019 2/2 with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Saran at Chapra in connection with Garkha P.S. Case No. 408 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. The petitioner is directed to deposit the said money in the court below within two weeks, will be subject to outcome of the case.
If the petitioner would acquitted in the case, the money will be returned to him. The money deposited will be invested in a place where the maximum amount will be earned by the said money and after settlement of money, the bail of the petitioner will be confirmed, otherwise the order will be treated to have been withdrawn. Accordingly, this application is disposed of.
