JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 376AB/34 and other allied sections of the Indian Penal Code and section 4 of Protection of Children from Sexual Offences (POCSO) Act, 2012. Petitioner is alleged to have committed rape on 11 years old daughter of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to village politics and the matter has also been compromised between the parties. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent.

Considering the nature and gravity of the offence,
