JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 45 of 2019, registered for offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 12.700 litres of liquor from co-accused Gulab Chaudhary, who disclose the name of petitioner as the person, who succeeded in fleeing away. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered in this case. Further he has no criminal antecedent and has been in judicial custody since 13.11.2019. Heard learned A.P.P. also.
