The petitioner apprehends his arrest in connection with Ayar P.S. Case No. 11 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is apparent that nothing has been recovered from the possession of this petitioner. The alleged recovery has been made from the bank of river.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.4890 of 2023(3) dt.08-02-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Exclusive Special Excise Court, Bhojpur at Ara in connection with Ayar P.S. Case No. 11 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
