In this case, the petitioners are seeking anticipatory bail in connection with Barharia P.S. Case No. 412 of 2019, registered for the offence under Sections 363/ 366(A)/34 of the Essential Commodities Act.

As per the F.I.R. the daughter of the informant is a student of Class-VIII of D.P.S., Kailgarh. On 19.11.2019, she went to school along with her brother and while she reached near the gate of the school, the accused persons kidnapped her for the purposes of marriage. However, the victim girl himself appeared and made statement that she of her own volition gone

Patna High Court CR. MISC. No.5446 of 2020(2) dt.29-02-2020 2/2 to Delhi and when she realized that she she has committed wrong she returned to the place.

Considering the entire facts and circumstances of the case, let the petitioners, above named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Barharia P.S. Case No. 412 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
