The petitioner is languishing in custody since 10.02.2015 in a case registered for the offences punishable under sections 341/323/379/384/307/34 of the Indian Penal Code. It is alleged that the accused persons assaulted the informant, demanded extortion of Rs. 5 Lacs and tried to strangulate him. The accused persons snatched Rs.2000/- and gold chain from the informant.

It is submitted by learned counsel for the petitioner that injury has been found to be superficial simple in nature. The injured was examined by a private doctor. The FIR was registered on 07.02.2015, which reached to the learned court below 09.02.2015. Moreover, the investigation has already

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No.91 of 2015. Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
