2. Petitioner seeks regular bail in connection with Rajauli P. S. Case No. 99/2024 in a case registered for the offences punishable under Sections 307, 147, 148, 149, 341, 324, 325, 379, 337, 338, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with other F.I.R. named accused persons, variously armed, came at the field of informant and demanded extortion money and when informant objected, accused persons started assaulting her by means of sticks, punches and kicks and when husband and son of the informant came to save her, this petitioner along with co-accused Pawan Kumar assaulted on the head of husband of
Patna High Court CR. MISC. No.6694 of 2025(2) dt.06-03-2025 2/2 the informant with axe as a result of which, he sustained injury.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus and no specific allegation of overt act is alleged against the petitioner. Petitioner claims clean antecedent and he is in custody since 28.10.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation, period of custody and other facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nawada in connection with Rajauli P.
