1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Khajekalan P.S. Case no.374 of 2025 registered under section 111(3) of the Bhartiya Nyaya Sanhita, 2023 and sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, on a search being conducted while a loaded country made pistol was recovered from the possession of the co-accused, it is stated that from the possession of the petitioner, a mobile phone was recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession.

5. The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, the petitioner having remained in custody for 4 months since 13.9.2025, charge-sheet having been submitted in the case and the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Khajekalan P.S. Case no.374 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna City, Patna.
