JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, I find that in course of investigation, confessional statement of co-accused was recorded and the aforesaid co-accused disclosed the involvement of the petitioner in the alleged crime. Furthermore, I find that petitioner was made accused in several cases and the I.O claimed that tower location of the mobile of the petitioner was found near the place of occurrence.
Learned counsel or the petitioner submits that except the aforesaid material, there is nothing against the petitioner and
Patna High Court Cr.Misc. No.15566 of 2016 (2) dt.19-04-2016 2/2 he is languishing in jail custody since 28.05.2015 but up till now he has not been put on T.I.P.
No doubt, petitioner carries criminal antecedent of several cases but taking into consideration the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Patna in connection with S.K.Puri P.S.Case No. 42 of 2015.
