This application for anticipatory bail arises out of Rani Talab P.S. Case No. 188 of 2018 for the offence under Section 364/34 of the Indian Penal Code.

My attention has been drawn to the statement of the alleged victim, recorded under Section 164 of the Cr.P.C., wherein the victim has made allegation of kidnapping against the persons named in the said statement. So far as these petitioners are concerned, there is vague allegation that they were also involved.

It has been argued on behalf of the petitioners that the petitioners are related to the first wife of the husband of the informant. The victim, as contended on behalf of the petitioners,

Patna High Court Cr.Misc. No.3248 of 2019(2) dt.24-01-2019 2/2 is said to have been adopted by the informant. Considering the nature of allegation against these petitioners, emerging from the statement of the alleged victim in her statement under Section 164 of the Cr.P.C., this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Mr. P.K.Malviya, learned J.M. 1st, Danapur in Rani Talab P.S. Case No. 188 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
