====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioners and the State.

Petitioners are apprehending their arrest in connection with a case registered for the offence under Sections 409, 419/34 of the Penal Code. They are named in the First Information Report, are said to have misappropriated the Government fund. First Information Report was registered on 05.09.2014. Petitioner Bashistha

Patna High Court Cr.Misc. No.13753 of 2015 (2) dt.22-05-2015 2/2 Narayan Singh, the then Junior Engineer superannuated in the year 2008, petitioner Awadh Bihari Pandey, the then Headmaster superannuated with effect from 30.09.2011 but the present First Information Report was lodged on 05.09.2014.

In the circumstances, both the petitioners are directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, if the contention that both retired much earlier is found true, they be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) each with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Sadar Motihari, East Champaran, Motihari/Chief Judicial Magistrate, East Champaran in connection with Harsidhi P.S. Case No. 296/2014, G.R. 4413/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
