JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Mahila (Khagaria) P.S. Case No. 61 of 2018 for the offence under Sections 354/509/504/506 of the Indian Penal Code and Section 67 of the Information Technology Act. Learned counsel for the petitioner submits that on account of intimacy, as the daughter of the informant and the petitioner were engaged in joint study, the petitioner has been able to take the photographs of the daughter of the informant. There is allegation that petitioner used to send filthy messages. Learned counsel appearing for the petitioner assures the Court that in case in future if the petitioner is found involved in similar matter or causing harassment to the daughter of the informant, his bail bond shall be cancelled. Considering the above mentioned facts, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four week from today, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty five thousand) with two sureties of the like amount to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Mahila (Khagaria) P.S. Case No. 61 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with further condition that the parents shall be the bailors and in the event of petitioner found harassing the daughter of the informant in future, the Court below shall be at liberty to cancel his bail bonds.
