The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 419, 420, 379, 120(B) and 34 of the Indian Penal Code. Allegedly, petitioner is member of an organized gang, which is involved in committing fraud by alluring innocent persons.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to enmity. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has been made accused in this case on the basis of

Patna High Court CR. MISC. No.5440 of 2023(2) dt.07-04-2023 2/2 information given by Sameer Kumar and Sonu Kumar. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State opposed the prayer for bail and has submitted that petitioner is member of an organized gang which is involved in committing fraud by alluring innocent persons to win award.

Considering the facts and circumstances of case and arguments of the parties, I am not inclined to enlarge the petitioner on anticipatory bail.
