JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-10-2021 The present petition has been filed at the behest of the petitioner for grant of regular bail in connection with Bakhtiyarpur P.S. Case No. 540 of 2017 under Section 364(A) of the Indian Penal Code. Apparently, the present petition is by way of fourth attempt on behalf of the petitioner for grant of regular bail, inasmuch as the prayer of the petitioner for grant of regular bail has been rejected thrice earlier.

The allegation against the petitioner and other accused persons is of kidnapping a minor boy and the said minor boy is stated to have been

On the earlier occasions, this Court had perused the case diary and it was found that the kidnapped victim boy was recovered from the house of the petitioner, hence, this Court was of the view that the involvement of the petitioner in the alleged heinous crime is apparent from the records, hence, the petitioner was denied the privilege of regular bail on earlier occasions. The learned Senior Counsel for the petitioner, Sri N.K.Agarwal, has submitted that the petitioner is languishing in custody since 3.12.2017, hence, at least, the trial court be directed to expedite the trial.

Having regard to the facts and circumstances of the case, this Court finds that there is no change in circumstance so as to warrant reconsideration of the prayer of the petitioner for grant of regular bail, and moreover, the petitioner is alleged to be having complicity in an offence of a grievous nature, hence, I do not find any merit in the present petition, thus, the
