JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-07-2021 Heard Mr. Shashi Bhushan Kumar, learned counsel for the petitioner and Mr. Akshay Lal Pandit, Additional Public Prosecutor for the State through video conferencing.
2. Petitioner seeks regular bail in connection with Maker PS Case No. 163/2020 registered for the offence punishable under Sections 272, 273, 414, 120(B) of the IPC and Section 30/30(a) of Bihar Prohibition & Excise Act 2016.
3. The prosecution case is that the police on the basis of secret information proceeded towards the place of occurrence and upon seeing the police party the accused persons started fleeing away and petitioner along with other accused persons were arrested and the police recovered 315 litres of illicit liquor from the two motorcycles parked at the place of occurrence.
4. Learned counsel for the petitioner submits that the

No.15285 of 2021(2) dt.09-07-2021 2/3 petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case by the police with oblique motive. Learned counsel further submits that no illicit liquor has been recovered from the conscious possession of the petitioner and the motorcycles, from where recovery has been made, do not belong to the petitioner. Learned counsel next submits that petitioner having no criminal antecedents is in custody since 14.12.2020 and the charge-sheet has also been submitted in the matter and there is no likelihood that petitioner will abscond or will tamper with the evidences if he is released on bail.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner having no criminal antecedent is in custody since 14.12.2020 and the charge-sheet has also been submitted in the matter and there is no likelihood that the petitioner will abscond or will tamper with the evidences if he is released on bail, I am inclined to grant regular bail to the petitioner.
6. Accordingly, let the petitioner, RAJEEV RANJAN be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.15285 of 2021(2) dt.09-07-2021 3/3 satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran in connection with Maker PS Case No. 163/2020.
