2. The petitioner apprehends his arrest in connection with Laheri P.S. Case No. 371 of 2024, registered for the offences punishable under Sections 417, 418, 420, 467, 468 & 34 of IPC.
3. The informant Vivek Kumar Tiwary made allegation that he resides in Dhanbad for his livelihood. When he came to his village on 01.04.2024, he found that only 10.75 decimals of the land appertaining to Khata no. 799, Khesra no. 5175 remained in the name of his mother Devanti Devi whereas

When he inquired about the matter, he came to know that co-accused Rajiv Ranjan @ Anish Tiwari who runs a computer center in Pawapuri, in collusion with co-accused Ramsnehi Shah (Revenue Karamchari) was involved in creating forged and fabricated mutation orders and they used to earn illegal money. Co-accused Rajiv Ranjan @ Anish Tiwary created a forged gift deed of the said land, claiming it to be executed by father of the informant in favour of himself, got his name mutated in the revenue records. Thereafter, Rajiv Ranjan @ Anish Tiwary sold that land to his mother (the present petitioner). On inquiry, it was detected that deed no. 7101 dated 28.07.2017 which Rajiv Ranjan @ Anish Tiwary claims to be the gift deed executed by father of the informant in his favour, was actually registered as gift executed by Kaloti Devi in favour of her daughter Swastika Pandey and son-in-law Akhilesh Kumar Pazhareru.
4. The learned counsel for the petitioner has submitted that the petitioner is an old lady, having no criminal antecedent. There is no allegation of forgery against her rather it is against her son, co-accused Rajiv Ranjan @ Anish Tiwari and Ram Sanehi Sah (Revenue Karamchari). He has submitted further that the land has been restored to the mother of the informant.

5. On the other hand, the learned APP for the State and the learned counsel for the informant have opposed the prayer for bail and submitted that the gift deed was obtained by co-accused Anish Tiwari on the basis of forged gift deed, in collusion with the Halka Karamchari.

Considering the above-mentioned facts and circumstances, especially the fact that the petitioner is a lady, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 371 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
