JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-08-2015 Heard both sides The petitioner seeks bail in a case under Sections 20, 22, 23, 24 of the NDPS Act.
The petitioner was apprehended with polythene bags containing 2.750 Kg. of Charas. The FSL report also shows that the recovered article is Charas (also known as Hashish), a contraband substance. Submission is that search was not made in accordance with law as contained in Sections 42 and 50 of the NDPS Act. The petitioner is in jail since 04.09.2013. Considering the fact that commercial quantity of Charas was recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail in Raxaul P.S. Case No. 263 of 2013, corresponding to NDPS Case No. 133 of 2013. Accordingly, the same is rejected.
