2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 302/34 of the Indian Penal Code.
3. As per allegation in the FIR, three accused persons, namely, Chandan Mahto having sword, Ramsevak Mahto armed with knife and petitioner armed with Dabiya came on motorcycle and entered into the house of the informant. Accused Chandan Mahto pierced sword in the chest of her husband, Ramsewak Mahto gave knife blow in his stomach as a result of which informant's husband fell down in the courtyard and died on spot. Patna High Court CR. MISC. No.6960 of 2024(5) dt.05-07-2024 2/3 Ramesh Mahto came for rescue and this petitioner assaulted him by means of dabiya on his stomach and he became senseless and fell down. They also assaulted to informant. Co-accused Chandan Mahto and Ramsewak Mahto were caught hold by the villagers and they assaulted him but petitioner succeeded to flee away taking the advantage of crowd.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific allegation against the petitioner is of assaulting to injured Ramesh Kumar and not to the deceased. It is mentioned in para 13 of the petition that there is case and counter case between the parties. Petitioner is brother of main accused Chandan Mahto, so his name has been dragged in the present case. Moreover, petitioner has got no criminal antecedent and he is languishing in languishing in judicial custody since 11.10.2023.
5. The application for bail is opposed by learned APP for the State and submitted that injured Ramesh Kumar has received three stitched wounds and doctor opined grievous in nature.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

No.6960 of 2024(5) dt.05-07-2024 3/3 petitioner is directed to be enlarged on bail after framing of charge, if not framed, on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Sitamarhi in connection with Parsauni P.S. Case No. 185 of 2022.
