JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Petitioner is languishing in custody since 23.03.2015 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
On commission of dacoity in the house of the informant led to the registration of the present case against unknown. The name of the petitioner sprang up on confession of the co-accused.
It is submitted by learned counsel for the petitioner that neither petitioner has been put on the test identification parade nor any recovery has been made from his possession. The statements to that effect have been made in para 12 and 13 of the petition.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.24224 of 2015 (2) dt.22-05-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Nanpur P.S. Case No. 353 of 2014.
