Mr.Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 The petitioner apprehends his arrest in connection with Harsidhi P.S.Case No. 366 of 2017 registered under Sections 302/34 of the Indian penal Code.

Allegation against the petitioner is of giving a Dabia blow to the father of the informant due to which he received injury and later on succumbed to injury as such Section 302 of Indian Penal Code has been added.

Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case and there is land dispute between the parties.

Heard learned APP also who has opposed the prayer for anticipatory bail stating that petitioner is one of the assailants. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender

Patna High Court Cr.Misc. No.6687 of 2019(2) dt.05-02-2019 2/2 within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
