Petitioner is in custody since 11.12.2015 in connection with Arwal P.S.Case No.56 of 2015 registered for the offence under Sections 394 and 302 of the IPC and Section 27 of the Arms Act.
As per the prosecution case, it is alleged therein that on 18.03.2015 at 2.35 to this effect that after receiving information regarding firing and snatching of Rs.49,800/- the police reached at the spot and found that one Gopal Sharma of village-Chanda received fire arm injury and during course of snatching money by unknown miscreants who was sent to the Sadar Hospital Arwal and thereafter in PMCH, Patna who later on died.
Patna High Court Cr.Misc. No.17403 of 2016 (4) dt.24-05-2016 It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2015. Chargesheet has been submitted in the case. Petitioner has falsely been implicated in this case on the basis of confessional statement of a co-accused. Petitioner has not been put on test identification parade nor any incriminating article is said to have been recovered from the possession of the petitioner.
On behalf of the State, it has been submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Arwal (Jehanabad) in connection with Arwal P.S.Case No.56 of 2015.
