JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 457, 380 and 411 of the Indian Penal Code. Petitioner is not named in the first information report but one Gautam Kumar was arrested in Barhiya P.S. Case No.16 of 2016 and on his disclosure some stolen articles of aforesaid case were recovered. Furthermore, the aforesaid Gautam Kumar disclosed the name of petitioner and also accepted that he had given Rs.5,000/- to petitioner to commit the present crime. Moreover, nothing is said to have been recovered from conscious possession of the petitioner and except the present case, there appears to be nothing against the petitioner which is evident from perusal of paragraph-3 of the petition.
Patna High Court Cr.Misc. No.16576 of 2016 (2) dt.26-04-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai in connection with Barhiya P.S. Case No.231 of 2015.
