JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he was also in the company of the co-accused Raushan Pathak, who fired from his pistol which hit informant's arms and back.

It has been submitted on behalf of the petitioner that he is in custody since 1.12.2015. He has got no criminal antecedent. Chargesheet has been submitted in the present case. As per F.I.R., no injury is attributed against the petitioner. The main allegation is against the co-accused Raushan Pathak. Similar statement has been made by the witness in para-68 of the case diary. On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
