2. The petitioner has preferred this application for grant of regular bail in connection with Adapur P.S. Case No. 229 of 2023 dated 23.07.2023 registered for the offences punishable u/s 392 of the I.P.C.

3. As per the prosecution case, three unknown miscreants boarded on Apache Motorcycle came and surrounded the informant and snatched his bag containing 3 kg. of Silver, 50 grams of Gold and two mobile phones and fled away. Accordingly, the FIR has been registered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.3634 of 2025(2) dt.25-02-2025 2/3 this case. The petitioner has no concern with the alleged recovery. The petitioner is not named in the FIR. No TIP has been conducted by the prosecution. The name of the petitioner has transpired merely on the basis of suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has eleven antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 08.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner has been identified in the CCTV footage installed near the place of occurrence.

Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioner as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran in connection with Adapur P.S. Case No. 229 of 2023, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
