Two petitioners, who are father-in-law and mother-inlaw of the complainant/opposite party no. 2, apprehending their arrest in Complaint Case No. 281 of 2018 registered for the offence under Sections 323, 341, 504, 498(A) of the Indian Penal Code, have approached this court for grant of bail, in the event of their arrest or surrender.
Considering the nature of accusation as well as fact
Patna High Court CR. MISC. No.7623 of 2019(4) dt.04-04-2019 2/2 that both petitioners are father-in-law and mother-in-law of the complainant, I am of the opinion that there is no reason to refuse the prayer for anticipatory bail.
Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let both the petitioners, namely, (i) Vinay Prasad and (ii) Sanju Devi be enlarged on bail on furnishing bail-bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Smt Sushmita Kumari, learned J.M., 1st Class, Patna City/ concerned court in connection with Complaint Case No. 281 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
