The petitioner seeks bail in connection with Sessions Trial No. 387B of 2011/ 28 of 2014 arising out of Rafiganj P.S. Case No. 163 of 2011 registered for the offences punishable under sections 387, 307, 353 read with 34 of the Indian Penal Code, 25(1-B)(a), 26, 27 of the Arms Act, 17 of the C.L.A. Act and 10 of the Unlawful Activities (Prevention) Act, 1967. It has been contended that the co-accused Ramjee Paswan on whose confessional statement the petitioner has been implicated in the present case has already been granted bail by a Bench of this Court vide order dated 25.04.2012 passed in Cr. Misc. No. 7772 of 2012. It has further been contended that apart

Regard being had to the facts and circumstances of the case, the petitioner Nepali Yadav, who is in custody since 18.02.2014, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Aurangabad in connection with Sessions Trial No. 387B of 2011/ 28 of 2014 arising out of Rafiganj P.S. Case No. 163 of 2011.
