The petitioner is facing prosecution in connection with Dariyapur P.S. Case No. 278 of 2015 for offence under Sections 302/201/34 of the Indian Penal Code and subsequently Section 394 of the Indian Penal Code has been added. It is a case of highway murder in which a driver and a Khalasi has been killed and the bodies of both the persons were thrown at different places. During investigation, Sanjay Prasad and the petitioner were arrested and on their confessional statement, cloth and knife were recovered from the roadside in the black poly packet.

This Court is not inclined to grant bail to the petitioner.

Patna High Court Cr.Misc. No.17165 of 2016 (2) dt.26-04-2016 Accordingly, the prayer for bail of the petitioner, namely, Vikash Kumar is rejected.

The trial court is directed to expedite the trial. If the trial is not concluded within a period of one year from today, the petitioner will be at liberty to renew his prayer for bail.
