JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-03-2024 Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks from today.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Kotwali P.S Case No. 59 of 2015 dated 01.02.2015 registered for the offence punishable u/s 419, 466 and 472 of the Indian Penal Code.

4. As per the prosecution case, on an application of Sri Manoranjan Kumar, Adv. AOR No. 01950, an inquiry was made in Patna High Court, where it was found that the petitioner filed

Misc. cases by putting forged signature of Sri Manoranjan Kumar, Adv. and his AOR No. Beside, the petitioner has also been found guilty for misusing the Adv. Clerk's Registration No. 460/2014, which happens to be that of Sri Ram Akwal Sing Adv. Clerk of Sri Niwas Singh. Adv.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner worked as an Advocate Clerk since the year 1975. It is further submitted that the signature of the concerned advocate was not done for any financial benefits. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Kotwali P.S Case No. 59 of 2015, subject to conditions as laid down under Section 438(2) of

Patna High Court CR. MISC. No.5925 of 2024(3) dt.12-03-2024 3/3 the Code of Criminal Procedure.

8. This application stands allowed.
