JUSTICE SUDHIR SINGH ORAL ORDER 14-02-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of Virtual Court proceeding. The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State through virtual mode.

Learned Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. The petitioner is apprehending his arrest in connection with Complaint case No.111/2015 registered under Sections 467, 468, 471, 474, 34 of the Indian Penal Code.

No.15087 of 2021(2) dt.14-02-2022 2/2 From perusal of the order of the Sessions Court, it appears that the process under Section 82 of Cr.P.C. has already been issued against the petitioner and the petitioner has been declared to be a proclaimed offender. The present case has been pending since 2015.

Considering the aforesaid facts, the present anticipatory bail is not maintainable in connection with Complaint case No.111 of 2015, pending in the court of learned Judicial Magistrate, First Class, Bikramganj, Rohtas. The anticipatory bail application stands disposed of. The petitioner, if so advised, may make an appropriate application before the court below in accordance with law. If any such application is made on behalf of the petitioner before the court below, same shall be considered on its own merit without being prejudiced by this order.
