The petitioner being the husband of the victim is facing accusation punishable under section 304B/34 of the IPC His prayer for bail was earlier rejected by order dated 21.1.2015(Annexure-1). The trial was required to be expedited. This is the second attempt of the petitioner for bail. Report called for from the trial court indicates that charges have already been framed and the witnesses have been summoned. Petitioner is in custody since 02.08.2014.
Considering the above, I am not persuaded to grant bail to the petitioner. Prayer is rejected. If the substantial number of prosecution witnesses are not examined within ten months
Patna High Court Cr.Misc. No.27983 of 2015 (4) dt.04-11-2015 2/2 from the date of receipt/communication of a copy of this order, the petitioner shall have liberty to renew his prayer for bail in the Court below itself.
