JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner No.2, Khaleel Miyan.
Prayer is allowed.
This anticipatory bail petition is dismissed as withdrawn against petitioner No.2.
Heard learned counsel for the petitioners and the State.
Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 379 and some other rminor Sections of the Indian Penal Code.
Patna High Court CR. MISC. No.5568 of 2022(2) dt.28-07-2022 2/2 As per the prosecution case, petitioner No.1 and 3 are alleged to have stabbed the informant in his stomach and back causing injuries to him.
Learned counsel appearing for the petitioners submits that in order to grab the land of petitioners this false case has been lodged. There is no repetition of blow and injuries are reported to be simple in nature. Petitioners have got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is direct and specific allegation against the petitioners that they stabbed the informant with knife causing multiple knife injuries to him. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners No. 1 and 3 on anticipatory bail. Accordingly, the same is rejected.
