JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is languishing in custody since 22.03.2015 in connection with Chhauradano P.S. Case No. 35 of 2015 for the offences instituted under Sections 392/511 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 21.02.2015 at about 11.00 P.M. the accused persons entered into the house of the informant armed with pistol and demanded ornaments, cash etc., then the informant went outside the house and cried then the villagers came and one co-accused Ramakant Yadav was apprehended who also disclosed the name of Rakesh Kumar and this petitioner.

No.25314 of 2015 (2) dt.21-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.03.2015 and the charge sheet has already been submitted in the present case. It is further submitted that the petitioner and the informant are own brothers. There is no recovery of any incriminating article from possession of the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Raxaul, East Champaran at Motihari, in connection with Chhauradano P.S. Case No. 35 of 2015.
