JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468, 471, 406 of the Indian Penal Code and 13 of Prevention of Corruption Act. The allegation against the petitioner is that he has misappropriated Indira Awas Yojna Scheme Fund to the tune of Rs. 45,000/- in collusion with other persons. It is submitted by the learned counsel for the petitioner that the petitioner happens to be the Panchayat Secretary of Balthi Rasulput Gram Panchayat and he has joined on the said post in the month of July, 2010 . It is further submitted that Sub-divisional Officer, Muzaffarpur(East) in his report dated 8th October,2012
Patna High Court Cr.Misc. No.19397 of 2017 (2) dt.12-06-2017 2/2 has reported that it is the Fatima khatoon, who has withdrawn the money even after death of Madina Khatoon.
Learned A.P.P. opposed the prayer for bail of petitioner and submitted that the petitioner has hand in misappropriating the government money.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Vigilance, North Bihar, Muzaffarpur in Special Case No. 25 of 2013/Bochahan P.S.Case no. 156 of 2013,subject to the conditions as laid down u/s 438(2) Cr.P.C.
