JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Parsa P.S. Case No. 165 of 2018, disclosing offences under Sections 341, 323, 504, 304/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other assaulted the wife of the informant by fists and slaps causing injury to her and later on she succumbed to the injury. Submission of learned counsel for the petitioner is that other co-accused Ravindra Sah has been granted bail by the lower court itself and the allegation itself shows that there is allegation of marpeet and there was no intention to kill the deceased.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of
Patna High Court CR. MISC. No.13041 of 2019(3) dt.30-04-2019 2/2 the petitioner on the ground that the other co-accused has been granted regular bail not anticipatory bail.
Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the court below within a period of six weeks and make prayer for regular bail, which will be considered on the basis of materials available on record, if possible, to be disposed of on the same day.
