20-03-2020 Heard learned counsel for the parties.

The petitioner seeks bail in Jokihat P.S. Case No. 290 of 2016 registered for the offence under Section 304B/34 of the Indian Penal Code.

As per F.I.R., it is case of dowry death of sister of the informant due to non-fulfillment of demand of dowry and petitioner is Bhaisur (elder brother of husband) of the deceased. It is submitted on behalf of petitioner that there is no specific allegation of demand of Dowry against the petitioner. The petitioner, being Bhaisur of deceased, was living separately since long and he has got no concern with the affairs of deceased and her husband. Petitioner is in custody since 28-11-2019, having no criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.3238 of 2020(3) dt.20-03-2020 2/2 well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Jokihat P.S. Case No. 290 of 2016.
