JUSTICE SANDEEP KUMAR ORAL ORDER 03-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seeks regular bail in connection with Goh P.S. Case No. 211 of 2021, registered for the offence punishable under Section 30(a)(c) of the Bihar Prohibition and Excise Amended Act, 2018.

Learned counsel for the petitioners submits that the petitioners are innocent and committed no offence. Nothing has been recovered from conscious possession of these petitioners. Illicit liquor has been recovered near the Sone river. Petitioners

Patna High Court CR. MISC. No.8463 of 2023(2) dt.03-05-2023 2/2 are in custody since 19.11.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, Excise II, Aurangabad (Bihar) in connection with Goh P.S. Case No. 211/2021.

This is also subject to the conditions that (I) the petitioner would cooperate in the proceeding of the court below. (II) the petitioner shall mark his presence in Goh Police Station, District- Aurangabad on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
