JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-10-2024 Though the present writ petition has been filed for removal of encroachment made over the land, appertaining to Khata No.386, Plot No.2043, 2047, admeasuring 3 acre 33 decimal, Plot No.1288, admeasuring 4 acre, 37 decimal and Plot No.1253, admeasuring 0.15 decimals, however, at the outset, the learned counsel for the respondent-State has submitted, by referring to the counter affidavit filed in the present case, that the Circle Officer, Sheosagar, District-Rohtas at Sasaram has already initiated encroachment proceedings, vide Encroachment Case No.4 of 2023-24, which shall definitely be concluded

Patna High Court CWJC No.1463 of 2024(3) dt.28-10-2024 2/2 within a stipulated time frame, as is fixed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Sheosagar, District-Rohtas at Sasaram to conclude the proceedings of the aforesaid Encroachment Case No.4 of 202324, in case the same have not yet been concluded, by passing the final order, under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

3. The writ petition stands disposed off on the aforesaid terms.
