JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 The petitioner apprehends his arrest in connection with Tisiauta P.S.Case No. 15 of 2018 registered under Sections 302 and 201/34 of the Indian penal Code.

Allegation against the petitioner is of causing death of her husband as she has having relationship with her brother-in-law. Submission of learned counsel for the petitioner is that while case diary shows that its a case of suicide and dead body was cremated by co-accused Tarun Paswan and not by the petitioner. He submits that petitioner has also a son aged about 4 years and a daughter aged about 14 years.

Heard learned APP also who has opposed the prayer for anticipatory bail on the ground that material has come in the case diary that petitioner has illicit relation with Tarun Paswan and due to that her husband has committed suicide and his dead

Patna High Court CR. MISC. No.3877 of 2019(3) dt.08-03-2019 2/2 body was also disappeared.

Having heard both sides and in view of the fact that petitioner is a lady having two minor children, in such view of the matter, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM,-IX, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 15 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that she will cooperate in investigation otherwise her bail bond shall be liable to be cancelled.
