2. The petitioner seeks bail in connection with Nawada Cyber P.S. Case No. 142 of 2025, instituted for the offences punishable under Sections 303(2), 318(2), 318(4), 319(2), 336(2), 336(3), 338, 340(2), 111, 317(2), 317(5), 61(2) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 66, 66(B), 66(C) and 66(D) of the I.T. Act.

3. The prosecution case, in short, is that on the information and tower location of the accused persons, the Police conducted a raid and arrested the petitioner along with other co-accused person. On search, two mobile phones and one motorcycle have been recovered from the possession of the

Patna High Court CR. MISC. No.4809 of 2026(2) dt.03-02-2026 2/3 petitioner. It is further alleged that the mobile phones were found containing data relating to Dhani Finance, Aadhaar, PAN and bank accounts.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submitted that the petitioner has been arrested only on the basis of suspicion. The allegation levelled against the petitioner is general and omnibus in nature. It is further submitted that the recovered mobile phones and motorcycle belongs to the petitioner. The petitioner is in custody since 29.08.2025 and has got no criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
