JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47-A of the Excise Act.
The alleged recovery is said to have been made from the house of Sarfi Lal but villagers disclosed that said house had been taken by the petitioner and one co-accused on rent. Admittedly, nothing has been recovered from conscious possession of the petitioner, who is languishing in jail custody since 01.02.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.16850 of 2016 (2) dt.28-04-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Judge-3-cum-A.C.J.M, Muzaffarpur in connection with Mushahari P.S. Case No. 155 of 2015.
