JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

Petitioner is not named in the first information report but it appears from the impugned order that except confessional statement of co-accused, Kishori Paswan, there is nothing against the petitioner. Moreover, petitioner is in jail custody since 28.12.2015 and except the present case as well as one Tekari P.S. Case No. 293 of 2012, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.18572 of 2016 (3) dt.03-05-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 337 of 2013.
