JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is languishing in custody since 23.07.2014 in connection with Raja Pakar P.S. Case No. 09 of 2014 for the offences instituted under Section 392 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 10.01.2014 at about 6.30 P.M., when the informant went his sister's home where he reached at 7 P.M. and when he was returning near Chakshikandar Petrol Pump he saw that one motorcycle was following him. At about 8 P.M. near N.H. 103 three miscreants on a motorcycle stopped him and on the point of pistol snatched his motorcycle and flee away. The informant saw the miscreants in the light of motorcycle.

No.25321 of 2015 (2) dt.21-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.07.2014 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner is not named in the F.I.R. nor there is any recovery of incriminating article from possession of the petitioner. It is further submitted that the petitioner has not been put on T.I. Parade to ascertain his implication in the present case. On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Vaishali at Hajipur, in connection with Rajapakar P.S. Case No. 09 of 2014.
