The writ petitioner, who was appointed as a Tax Collector and retired from the post of Lower Division Clerk from Sasaram Nagar Parishad (now Sasaram Nagar Nigam), has filed this writ petition for payment of gratuity, provident fund (contribution of employer), group insurance, unutilized earned leave and revision of pension in the pay-scale of post.

3. A counter affidavit has been filed on behalf of respondent no. 4, wherein, in paragraph nos. 6 and 7, it has been stated that all the post retirement benefits of the petitioner including the differential amount of salary, pension and gratuity on account of 5th pay revision, have been paid.

4. Though, counter affidavit, on behalf of respondent no. 4, was filed on 01.08.2023, but no rejoinder has been filed by the petitioner, controverting the averments made in the said counter affidavit.

5. Since, from the averments made by respondent no. 4 in the counter affidavit filed, it appears that the relief, sought for by the petitioner, appears to have been granted, this writ petition shall stand disposed of with no consequential order.
