2. The present petition has been preferred for the following relief/s:
(i) for issuance of appropriate writ in quashing of Order dated 27-3-20118, contained in ANN-passed by the Divisional
Patna High Court CWJC No.23860 of 2018(2) dt.11-11-2025 2/3 Commissioner, Patna in dismissing the Land Ceiling Revision No. 174/2011 and affirming the order dated 6-9-2011, contained in ANN7, passed by the Addl. Collector, Nalanda in Land Ceiling Appeal No. 03/2008-09 allowing the appeal & in setting aside the order of learned Deputy Collector, Land Reforms, Biharsharif (for short-DCLR) dated 19-5-2008, contained in ANN-S, passed in L. C. Case No. 05/04-05 by which pre-emption application u/s 16(3) of Bihar Land Reforms (Fixation of Ceiling Area & Acquisition of Surplus Land) Act, 1961(For short- the Ceiling Act), was allowed in favour of petitioner and consequently, to allow the Land Ceiling Revision no.
174/2011 aforesaid also;
(ii) during pendency of this application, the operation of impugned order of Divisional Commissioner, contained in ANN-8, may be stayed and in compliance of section 16 (3) (ii) of the Ceiling Act, the petitioner be put in
Patna High Court CWJC No.23860 of 2018(2) dt.11-11-2025 3/3 possession over land-in-question detailed here-in-after.
3. At the outset, it has been informed by Mr. Singh that the matter relates to pre-emption and as such with the new development, no case remains.
4. In that background, the writ petition is disposed of.
