The petitioner apprehends his arrest in a case under Sections 376/511 of the Indian Penal Code.
The prosecutrix made a very specific allegation that the petitioner entered into her house at the dead of night and made an attempt to commit rape with her. It is submitted that the petitioner happens to be the brother-in-law of the prosecutrix and the allegation is false. Compromise is also arrived at. Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in Motihari Mahila P.S. Case No. 23 of 2014. Accordingly, the same is rejected. The petitioner is directed to surrender in the court below within four weeks from the date of receipt / production of a
Patna High Court Cr.Misc. No.24934 of 2015 (2) dt.14-07-2015 2/2 copy of this order and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order.
