Heard the parties.
At the very outset, it is pointed out that dispute has already been settled by the parties and a compromise petition was filed in Execution Case No. 05 of 2016 which was disposed of by the executing court in the light of compromise petition filed jointly on behalf of the parties. It is also pointed out that respondents have already received the compensation amount which is evident from perusal of Annexure-4 to the supplementary affidavit and, therefore, in the aforesaid circumstances, the amount which was kept in Bank Account bearing no. 00600350093073 in the H.D.F.C. Bank, Naugachia Branch, Bhagalpur be released in
Patna High Court MA No.250 of 2016 (6) dt.27-04-2017 2/2 favour of the appellant.
Learned counsel for the respondents does not raise any objection.
In view of the aforesaid submission, this miscellaneous appeal stands disposed of. Consequent thereupon, the amount kept in the account vide order dated 29.08.2016 is ordered to be released in favour of the appellant. Furthermore, the statutory amount deposited in this court be also released in favour of the appellant.
