KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-02-2020 This petition filed on 14.02.2020 is listed for hearing for the first time today before the Court.
Appellant has prayed for the following reliefs:- (i) For issuance of writ in the nature of
4/5 mandamus or any other appropriate writ/direction for directing the respondents to set up enquiry against the erring authorities to be done by the competent authorities/agencies in the matter of financial irregularities/misappropriation of a large fund (public exchequer) of Rs. 340 Crores (Rupees Three Hundred Forty Crores) which has been provided by the State Government for purchasing of Laboratories Equipments and furniture in the Secondary and Higher Secondary (+2) Schools situated in the State of Bihar and thereafter to punish the erring authorities.
(ii) For issuance of writ in the nature of mandamus or any other appropriate writ/direction for directing the respondent authorities to obtain utilization certificate from the Disbursing Authority/Headmaster and also to recover the residual (unutilized) amount from Disbursing Authority/Headmasters of the School. After the matter was heard for some time, learned counsel for the appellant submits that appellant shall be content if a direction is issued to the concerned respondents/authority to consider and decide the representation, which he shall be making within a period of four weeks from today. Learned counsel for the respondents states that upon receipt of such representation, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of four months from the date of receipt thereof. The appeal is accordingly, disposed of reserving
