JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2022 Heard learned counsel appearing for the petitioner and learned counsel for the State through virtual mode. Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

It is alleged that in course of returning his village, in the way, four unknown persons abused him and snatched cash Rs. 20,000/- and a Nokia Mobile from him.

The petitioner is apprehending his arrest in Jamo Bazar P.S. Case No. 11 of 2017 registered for the offence under Section-392 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is no allegation of tampering of witnesses against the petitioner. The petitioner has falsely been implication in the present case.

The name of the petitioner has transpired in this case on the basis of confessional statement of the co-accused made before the police under Section-161 of the Cr.P.C. Except for this, there is no evidence to suggest the implication of the petitioner in the present case. There is no recovery of any incriminating article from possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, in the event of arrest or surrender within a period of twelve weeks, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Siwan in connection with Jamo Bazar P.S. Case No. 11 of 2017 subject to the conditions as laid down under Section-438(2) of the Cr.P.C.
