Petitioner apprehends arrest in registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
As per prosecution case, 15.840 liters of county made liquor was recovered from motorcycle of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely because he is owner of the vehicle. No incriminating material has been recovered from the conscious possession of the petitioner. He next submits that as a matter of fact, without the knowledge and consent of the petitioner, the vehicle in question was being used for transportation of liquor
Patna High Court CR. MISC. No.4874 of 2023(2) dt.07-04-2023 2/2 and as such, he cannot be held responsible.
Learned counsel for the State opposes the prayer for bail and submits that since 15.840 county made liquor has been found from the motorcycle of the petitioner, he cannot escape liability for the same.
Considering the aforesaid facts, prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
